WALKED Terms of Service
Effective date: October 20, 2026
Terms version: terms-2026-10-20-v1
These Terms are a contract between WALKED LLC, an Ohio limited liability company ("WALKED," "we," "us") and the business or licensed inspector that signs up ("Customer," "you"). They cover the WALKED inspection software, apps, websites, AI features, templates, messaging tools and done-for-you website and SEO services (together, the "Service").
Our Privacy Policy (https://trywalked.com/privacy/) and Data Processing Addendum ("DPA," https://trywalked.com/dpa/) are part of these Terms. If these Terms and the DPA conflict on personal data, the DPA controls.
---
1. Who can use WALKED
1.1 Business use only. The Service is for businesses. You must be a business entity or a home inspector who is licensed where your state requires it, and you must use the Service for your business. Do not use it for personal, family or household purposes.
1.2 Age and authority. You must be at least 18. If you accept for a company, you confirm you have authority to bind it.
1.3 Accurate information. Your license number, license expiration, business name and contact details must be accurate, and you must keep them current. WALKED may ask for proof of licensure.
2. Accounts and security
2.1 Keep your login private. Use a strong password that you don’t use anywhere else, and tell us right away at hello@trywalked.com if you think someone else has used your account.
2.2 You are responsible for activity under your account and for your team members' accounts. Each person gets their own login, and accounts may not be shared.
2.3 Tell us right away at hello@trywalked.com if you think your account was accessed without permission.
3. Plans, fees, auto-renewal and cancellation
3.1 Fees. You agree to pay the fees for the plan you choose, as shown at checkout or in your order. Fees exclude taxes unless stated. Payments are processed by our payment processor, Stripe.
3.1A Current prices (US dollars, before tax). WALKED Reports: $39 per month or $390 per year. WALKED Reports + Website + SEO is coming soon and is not yet available to buy; its price will be shown to you before you can choose it. Pay-per-report: $9 per report, never more than $39 in a calendar month. Founder pricing (the first 10 founding inspectors, after their free year): Reports $29 per month or $290 per year. Founder prices are locked while your subscription stays active.
3.1B Card authorization. By entering a payment card at checkout and confirming your plan, you authorize WALKED, through its payment processor Stripe, to charge that card (or a replacement card you add) the price shown for your plan and term, plus applicable taxes, at the start of each term and on each renewal until you cancel. For pay-per-report, you authorize a monthly charge of $9 per report, capped at $39 per month. You confirm you are authorized to use the card.
3.1C Founder free year. Founding inspectors get their first 12 months free and do not need to enter a card to start. We will not charge you for anything at the end of the free year unless we have emailed you notice at least 30 days before the free year ends, and again 7 days before, stating the price and how to cancel, and you have added a card. If no card is on file when the free year ends, your plan pauses; nothing is charged, and you can still export your data for 90 days. If you add a card within those 90 days, you keep your founding rate. Report links you already sent to buyers stay live for those 90 days. If your plan is canceled or paused for non-payment, you can still export your data for 90 days.
3.2 Auto-renewal.
YOUR PLAN RENEWS AUTOMATICALLY. Unless you cancel before the end of the current term, your plan renews for the same term length (monthly or annual) at the then-current price, and we charge your payment method on file.
This notice is shown at checkout and before you enter payment details.
3.3 Renewal reminders. For annual plans, we will email a reminder 30 to 60 days before the renewal date. It will say the plan will renew unless you cancel, give the price, and explain how to cancel. We will notify you of price changes at least 30 days before they apply.
3.4 Cancel anytime online. You can cancel at any time in Settings → Billing → Manage billing, which opens our secure billing portal (operated by Stripe), or by emailing hello@trywalked.com. Cancellation takes effect at the end of the current paid term, and you keep access until then. No further renewal charges are made after you cancel.
3.5 Refunds. Refunds are handled as described on our Refunds page. Except where the law requires otherwise or that page says otherwise, fees already paid are non-refundable.
3.6 Late payment. If a payment fails, we will email you and retry. If it is still unpaid 14 days after that notice, we may suspend the Service under Section 14.
4. Your content and data belong to you
4.1 You own your content. You own everything you or your clients put into or create with the Service. That includes your reports, photos, notes, findings, agreements, client and homebuyer information, agent contacts, branding, website content, and any domain names registered for you ("Customer Content").
4.2 Our limited license. You give WALKED a limited, non-exclusive, worldwide, royalty-free license to host, store, copy, transmit, display, format and process Customer Content. We use it only to provide, secure and support the Service for you, as described in the DPA, or where the law requires. (We improve the Service using only de-identified, aggregated usage data under Section 4.6.) We do not get any other rights.
4.3 Domains. WALKED does not currently register domains for you. If we ever register one for you as part of a done-for-you service, it will be registered in your name or transferred to you on request. We will provide transfer authorization codes within 5 business days of a request, including after termination, subject to any unpaid registrar fees.
4.4 No sale of data. WALKED does not sell Customer Content or your clients' personal information. We do not share it for targeted advertising, and we do not use it to market to your clients.
4.5 No sharing by default. The Service is set up so findings and client information are not disclosed to anyone outside the contract's authorized recipients unless the named client has given written permission. (In Ohio, inspectors need the client's prior written approval; see OAC 1301:17-1-16(C).) You control and are responsible for any sharing you turn on.
4.6 Usage data. WALKED may use de-identified, aggregated usage data that does not identify you, your clients, or any property address. We use it to run and improve the Service.
4.7 Feedback. If you send us suggestions, we may use them without obligation to you.
4.8 Public samples. Sample reports and demo sites on WALKED's own website are built from real inspection photos and narratives. Identifying details such as property address and owner are removed. We will never publish your Customer Content as a sample or marketing material without your written permission. If client information is included, the named client's written permission is also required.
5. Export and deletion
5.1 You can export your account data at any time in Settings › Export my data. The export is a ZIP file with your clients, buyer’s agents, orders, services, invoices, agreements and website messages as CSV files, your reports and findings as a JSON file, and copies of signed agreements as PDFs. Photos are not included in the self-serve export yet; email hello@trywalked.com and we will provide your original photos within 10 business days.
5.2 After termination, you have 90 days to export your data. Read-only access or an export file is available on request at hello@trywalked.com. After the 90 days, we delete Customer Content on the schedule in DPA Section 8 (which we apply to all Customer Content, not only Client Data), except where the law requires us to keep it or a litigation hold applies.
5.3 Your retention duties are yours. Licensing laws may require you to keep contracts, reports and work files for years. For example, Ohio requires 5 years from report delivery (ORC 4764.11(B)). Export and keep your records before you close your account.
6. You are the licensed professional
6.1 You alone are responsible for:
- your licensing and insurance;
- complying with your state's standards of practice and ethics rules;
- your pre-inspection agreements and required disclosures;
- the content, accuracy and delivery of every report; and
- all communications with your clients, agents and the public.
6.2 WALKED provides software. It does not inspect homes, give professional opinions, review your reports for accuracy, or act as your client's inspector.
6.3 Checklists, gates and standards-of-practice prompts in the Service are aids only. They may be incomplete or out of date. Passing a WALKED check does not mean your report complies with any law or standard.
6.4 Agreements are signed by the client. Pre-inspection agreements must be signed by the client, or by a person holding the client's written authorization. They must not be signed by a real estate agent on the client's behalf without that authorization. The Service may block agent-account signatures.
7. AI features
7.1 Some features use artificial intelligence, including third-party AI model providers listed on our Subprocessors page. The following notice appears in the product, and you agree to it:
AI suggestions are drafts. The AI is not a licensed home inspector. The licensed inspector must review all output and is solely responsible for the report's accuracy and compliance with applicable standards of practice.
7.2 AI output can be wrong, incomplete or inconsistent. You must review and edit it before using it, and you may not deliver AI output to a client without your own professional review.
7.3 WALKED does not use your Customer Content to train AI models. We send Customer Content to our AI providers only to provide the feature you asked for, and they are listed on our Subprocessors page. See the Privacy Policy and DPA.
7.4 AI features run only when you use them (for example, dictating a note, reading a data plate, or asking the assistant to draft text). You can write and edit every report by hand without them.
8. No fake reviews or testimonials
8.1 WALKED does not write, generate, buy, seed, edit or filter reviews or testimonials for you. The Service is not designed to do so,. The in-app assistant refuses requests to draft, edit or reply to reviews or testimonials, and you may not use any AI feature to draft them.
8.2 You may not use the Service to:
- create, post or display fake or AI-generated reviews or testimonials;
- post reviews by owners, employees or relatives without clear disclosure;
- suppress or selectively hide negative reviews;
- offer incentives for only positive reviews; or
- buy or display fake followers or other social-media indicators.
See the FTC Rule on Consumer Reviews and Testimonials (16 CFR Part 465) and the FTC Endorsement Guides (16 CFR Part 255).
8.3 Review widgets may show only genuine reviews from real customers.
9. Done-for-you websites and SEO
9.1 If you buy website or SEO services, we will build and maintain the site described in your order. You will review and approve content before it goes live.
9.2 No ranking guarantee.
WALKED does not guarantee any search ranking, traffic, or leads; search engines control results.
9.3 Your advertising, your responsibility. Your website is your advertising. You are responsible for making sure everything on it is true and accurate, including your license number, credentials, service area, pricing and claims. You confirm that you will tell us about any changes. (In Ohio, see OAC 1301:17-1-16(E)(1); in Florida, see Fla. Stat. 468.832(1)(f).)
9.4 Images and property photos. You warrant that:
- you own or are licensed to use every image, logo, video and text you give us; and
- for any photo or description of an identifiable property used in advertising, including your website, social posts and sample pages, you have the express written consent of the property's current owner of record where required. Ohio requires this under OAC 1301:17-1-16(E)(2).
We will not post photos from your inspections to your website unless you confirm that consent in the Service. Stock images we supply are licensed for use on your site only.
9.5 Site privacy and accessibility. If your site collects leads or uses analytics, it needs its own privacy policy, and we can add one from a template you approve. We design toward WCAG 2.1 AA accessibility but do not guarantee that any site is free of accessibility claims.
9.6 When services end. Your content and domain stay yours (Section 4). WALKED-owned themes, code and stock image licenses stay with WALKED. We will give you an export of your site content.
10. Templates
10.1 WALKED may provide sample agreements, disclosures, emails and other templates. Each template carries this notice, and you agree to it:
Sample template only, not legal advice. WALKED is not a law firm. Have a licensed [STATE] attorney review before use.
10.2 WALKED staff cannot tell you which clauses to use or how to fill them in, and cannot say whether a clause is enforceable. We do not represent that any template is "enforceable," "attorney-approved" or compliant with your state's law. You are responsible for adapting templates to your state and business.
11. Email and text-message features
11.1 You are the sender of the emails and texts you send through the Service, including booking confirmations, reminders and agent outreach. You are responsible for complying with messaging laws, including CAN-SPAM, the TCPA, the National Do Not Call rules, and state laws such as Florida's Telephone Solicitation Act.
11.2 You must:
- get and keep any consent the law requires before sending texts, especially marketing texts;
- honor STOP and other opt-out requests promptly. Once text messaging is turned on for your account, the Service processes STOP replies automatically. The Service processes email unsubscribe links automatically, and other email opt-outs within 10 business days;
- include your business name and valid physical postal address in marketing emails;
- not upload purchased, scraped or harvested contact lists; and
- not send marketing texts to people who have not given documented consent.
11.3 10DLC. Business texting in the U.S. requires carrier registration ("10DLC" brand and campaign registration). You agree to provide accurate registration information. Messages may be blocked until registration is approved.
11.4 We may limit, pause or block messages that appear to violate law, carrier rules or these Terms.
11.5 Agent relationships. Do not use the Service to offer or deliver compensation, gifts or anything of value to real estate licensees for referrals or for placement on preferred-provider lists where your state prohibits it. Ohio prohibits this under OAC 1301:17-1-16(B)(4), and Florida under Fla. Stat. 468.8319(1)(h). Federal RESPA rules may also apply (12 USC 2607).
12. Acceptable use
You may not use the Service to:
- (a) break any law, or misrepresent your license status or credentials;
- (b) disclose inspection findings or client information without the authorization your state requires;
- (c) upload malware, probe or attack the Service, or bypass security or usage limits;
- (d) scrape, copy or reverse engineer the Service, except as the law allows;
- (e) resell or sublicense the Service without our written permission;
- (f) infringe anyone's intellectual property or privacy rights;
- (g) upload Social Security numbers, full payment card numbers, or health information, unless a field is designed for it;
- (h) send spam or unlawful texts or calls; or
- (i) use a competitor's confidential information, code or materials in connection with WALKED.
13. Our intellectual property
WALKED owns the Service, including software, design, templates, standards-of-practice tooling and documentation. Subject to these Terms, we give you a limited, non-transferable right to use the Service for your business while your subscription is active. WALKED's name and logo may not be used without permission, except to say truthfully that you use WALKED.
14. Suspension and termination
14.1 You may cancel anytime (Section 3.4).
14.2 We may suspend or end your access if you materially breach these Terms and do not fix it within 10 days of notice. We may act immediately where needed to prevent harm, legal violations or security risks, or if fees are unpaid under Section 3.6. We will tell you why unless the law prevents it.
14.3 We may discontinue the Service with at least 60 days' notice and a pro-rated refund of prepaid fees for the unused period.
14.4 After termination, Section 5 (export and deletion) applies. Sections 3 (for fees owed before termination), 4, 5, 6, 9.4, 10, 11.1–11.2, 12, 13 and 15 through 21 survive.
15. Warranty disclaimer
We will provide the Service with reasonable skill and care. Otherwise, the Service, AI output, templates and content are provided "as is" and "as available." To the fullest extent the law allows, WALKED disclaims all other warranties, express or implied, including merchantability, fitness for a particular purpose, title and non-infringement. We do not guarantee that the Service will be uninterrupted or error-free, or that any output is accurate or legally compliant.
16. Limitation of liability
16.1 Cap. To the fullest extent the law allows, each party's total liability arising out of or relating to these Terms is limited to the fees you paid to WALKED in the 12 months before the event giving rise to the claim.
16.2 No consequential damages. Neither party is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, business or goodwill, even if advised of the possibility.
16.3 Exceptions. These limits do not apply to:
- your payment obligations;
- either party's indemnity obligations under Section 17;
- a party's gross negligence, fraud or willful misconduct; or
- liability that cannot be limited by law.
17. Indemnity
17.1 By you. You will defend and indemnify WALKED against third-party claims arising from:
- your inspections, reports, agreements or professional services;
- your Customer Content, website content or advertising;
- your messages and outreach; or
- your breach of these Terms or the law.
17.2 By WALKED. WALKED will defend and indemnify you against third-party claims that the Service, as we provide it, infringes a U.S. patent, copyright or trademark or misappropriates a trade secret. This does not cover claims caused by your content, your changes, or combinations we did not provide. If such a claim happens, we may modify the Service, get you a license, or end the affected feature and refund prepaid fees for it.
17.3 Process. The party seeking indemnity must give prompt notice, give reasonable cooperation, and let the other party control the defense. No settlement that admits fault or imposes obligations is allowed without consent, which may not be unreasonably withheld.
18. Data protection
The DPA (https://trywalked.com/dpa/) is incorporated by reference. In it, WALKED acts as your processor for Client Data (as defined in the DPA: client, homebuyer, property-owner and agent information, plus findings, reports, photos and agreements). Our current subprocessors are listed at https://trywalked.com/subprocessors/.
19. Changes to these Terms
We may update these Terms. For material changes, we will give at least 30 days' notice by email and in the app, and we will ask you to accept the new version before continuing to use the Service. Changes to fees follow Section 3.3. If you do not agree, you may cancel before the change takes effect and receive a pro-rated refund of prepaid fees for the unused period. Non-material changes, such as clarifications or new optional features, take effect when posted.
20. Governing law, venue and disputes
20.1 These Terms are governed by the laws of the State of Ohio, without regard to conflict-of-laws rules.
20.2 Any lawsuit must be brought in the state or federal courts located in Montgomery County, Ohio, and both parties consent to those courts.
20.3 No arbitration. Disputes are resolved in the courts named in Section 20.2.
20.4 Before filing any claim, each party will try in good faith to resolve the dispute informally for 30 days after written notice.
21. General
- Notices. We send notices to your account email. Send notices to us at hello@trywalked.com. Notices are effective when sent by email, or when delivered if sent by mail.
- Assignment. You may not assign these Terms without our consent. We may assign them in a merger, acquisition or sale of assets, with notice to you.
- Force majeure. Neither party is liable for delays caused by events beyond its reasonable control.
- Entire agreement. These Terms, the Privacy Policy, the DPA and your order form are the entire agreement.
- Severability. If a provision is unenforceable, the rest stays in effect.
- No waiver. Not enforcing a provision is not a waiver of it.
- Relationship of the parties. Neither party is the other's agent, employee or partner.
- Electronic records. You agree to receive these Terms, notices and records electronically.
